The EU Law Retention bill seeks to provide a framework for the gradual transformation of the accumulated EU originated regulations and case law and their revocation, replacement or retention in UK law. The Act will end the supremacy of EU law in the UK save for certain key exceptions. It will also continue a means by which the lower courts may seek a form of reference to the appellate courts on cases before them which raise contentious issues of EU law.
The bill is now being scrutinised by the House of Common Public Bills Committee and Mr Sharpe KC was invited to give evidence in a session which followed Sir Stephen Laws, the former First Parliamentary Counsel and Professors Catherine Barnard and Alison Young of Cambridge.
