Matthew Hoyle has today given evidence before the Property (Digital Assets etc) Bill Special Public Bill Committee. It follows from from his contribution to the COMBAR and Chancery Bar Association joint response to the Law Commission’s call for evidence on its proposals in the Digital Assets: Final Report (2023) Law Com No.412 in June 2023.
The Property (Digital Assets etc) Bill, which resulted from those proposals and which is now before Parliament, is concerned with the status of crypto-assets and other novel types of assets in English law. The Special Public Bill Committee sought further evidence from COMBAR as to the potential effects of the Bill, including the effects it might have on future litigation relating to crypto-assets in England and Wales, the risks of unforeseen consequences of the Bill and whether it should be given retrospective effect.
