‘Foundations of Indian Contract Law’ (OUP 2024) was published today.
The book comprises 24 chapters written by 32 academics and practitioners from around the world. The chapters consider:
- General themes such as the history of the Indian Contract Act 1872, its legislative design, the Act’s transplant to Malaysia and the Indian Courts’ approach to contractual interpretation;
- Core concepts of Indian contract law such as formation, termination, vitiating factors and remedies;
- Special contracts such as shareholder agreements, indemnities, guarantees and contracts with the State; and
- Concluding remarks by Professor Hugh Beale.
The book is edited by Niranjan Venkatesan and KV Krishnaprasad (along with Shivprasad Swaminathan and Umakanth Varottil). Steven Elliott KC wrote the chapter on rescission (along with Divya Behl).
