Following a trial in December 2009, Mr Justice Griffith Williams dismissed the Claimant Formula One team’s claim for sponsorship monies and ordered it to repay to Mr Rodriguez monies he had already paid. The Judge held that the Sponsorship Agreement had been procured by misrepresentations and also held that Force India had deliberately breached the agreement by sabotaging Mr Rodriguez’s son’s application for a Super Licence. The Judge implied a term into the agreement that Force India was required to co-operate in the application process and held that it had failed to do so because it had decided it wanted Giancarlo Fisichella to drive for the team and not Mr Rodriguez’s son.
