James Petkovic has written an article for PLC on risks faced by companies arising out of environmental, social or governance (“ESG”) concerns. This is presently an extremely active area of litigation with multiple claims before, or recently before, the Courts seeking recovery based on ESG concerns. Major recent decisions such as Okpabi v Royal Dutch Shell [2021] UKSC 3 and Lungowe v Vedanta Resources [2019] UKSC 20 (both concerned with alleged polluting activities by multinationals in Africa) are considered in the article as well as other decisions concerned with ESG concerns such as Jalla v Shell International Trading Co Ltd [2021] EWCA Civ 1389 and Begum v Maran [2021] EWCA Civ 326.
