Rohilla v Holt
Claimant golfer Rina Rohilla has successfully obtained an injunction requiring Royal Mid Surrey Golf Club to reinstate her membership. Ms Rohilla had been expelled on allegations that she cheated by amending her scorecard. Ms Rohilla argued that the expulsion was in breach of the Club’s rules as being procedurally unfair and motivated by bad faith on the part of the committee, as well as irrational.
After a three-day trial, in a judgment released today, His Honour Judge Holmes upheld Ms Rohilla’s allegations of breach of contract on grounds of procedural fairness and bad faith, and granted an injunction requiring the Club to reinstate her.
