In a Judgment handed down on 15 February 2024, the Competition Appeal Tribunal has found that collective proceedings brought by Dr Liza Lovdahl Gormsen against Meta alleging abuses of dominance should be certified.
In essence, Dr Gormsen alleges that Facebook's collection of data from its users in relation to their activities off Facebook's social media site involves an unfair bargain.
Having previously been refused certification in February 2023, the CAT found that Dr Gormsen’s reformulated case passed the Pro-Sys test.
